WHAT IS LOCAL LAW 88
LIGHTING UPGRADES AND SUBMETERING?

Local Law 88 of 2009 —and its subsequent expansions with Local Law 132 and 134, both of 2016—requires common areas in residential buildings greater than 25,000 square feet and all areas in non-residential buildings greater than 25,000 square feet to upgrade lighting to meet current New York City Energy Conservation Code standards by January 1 st, 2025. The original law and its subsequent expansions also require all non-residential buildings greater than 25,000 square feet to install electrical sub-meters for each large non-residential tenant space greater than 5,000 square feet and provide monthly energy statements.

TENANT ELECTRIC METER REVIEW 

  • A complete review of all tenant electric meters must be conducted. For any tenants greater than 5,000 square feet that do not receive monthly electrical consumption statements either from the local utility or submetering provider, a new electrical submeter will need to be installed.

  • Once the review and/or required submeter installations are completed, a report must be created that includes:​​​​​

Building Construction

A list of all covered tenant spaces within the building.

Abstract Building

An attestation by a registered design professional, a licensed master electrician, or a licensed special electrician certifying that sub-meters havebeen installed for all covered tenant spaces in accordance with Article 311 of Title 28 of the Administrative Code.

Office Building Hall

A sample monthly statement in accordance with section 28-311.4 of the Administrative Code.

CERTIFICATION

Obtain certification from a registered design professional, licensed master electrician, or special electrician confirming that the lighting systems comply with legal requirements.

WHAT ARE THE PENALTIES FOR NOT COMPLYING WITH LOCAL 88?

SUBMETERING

Failure to file a submeter installation report will incur a fine of $1,500 and will be assessed annually until such report is filed. Where a report is filed, but submeters have not been installed in all covered tenant spaces, a fine of $500 for each covered tenant space where submeter has not been installed will be assessed annually until all required submeters are installed.

LIGHTING UPGRADES

Failure to file a lighting upgrade report will incur a fine of $1,500. Such a penalty will be assessed annually until the compliance report is filed.
